& TERMS AND CONDITIONS

​We understand there is a bit to read here, but these terms help ensure that expectations, responsibilities and boundaries are clear for both you and us. Please take a few moments to read these Terms and Conditions carefully before purchasing or commencing any service.

By accessing our website, purchasing a product or service, booking a consultation, or engaging Jules McKie Health, you acknowledge that you have read, understood and agreed to these Terms and Conditions.

​

1. General Disclaimer

The Jules McKie Health website may contain blog articles, e-books, recipes, health information, nutrition information, healthy living suggestions and general educational content. All website content is provided for general informational and educational purposes only. It is not intended to constitute medical advice, diagnosis, treatment or a substitute for advice provided by your doctor, medical practitioner or other appropriately qualified healthcare professional.

You should consult your doctor or appropriate healthcare professional before making significant changes to your diet, lifestyle, exercise, medication or supplementation, particularly if you have a diagnosed medical condition, are pregnant or breastfeeding, take prescribed medication, or have known allergies or intolerances. Information provided through Jules McKie Health is intended to support education and informed health choices and should not be relied upon as a substitute for appropriate medical care.

2. Scope of Services & Referrals

Jules McKie Health provides functional nutrition and gut health services within the scope of our training, qualifications, experience and professional expertise. As a Functional Nutritionist and Gut Health Therapist, I recognise the limitations of my scope of practice. Where a health concern falls outside the services or expertise I am able to provide, or where further medical assessment is considered appropriate, I may recommend that you consult another appropriately qualified practitioner, including a general practitioner, medical specialist or other healthcare professional. A referral or recommendation to seek medical or other professional assistance does not constitute a diagnosis.

3. Our Responsibilities

Jules McKie Health will take reasonable care to provide services and information in a professional manner and to the standard reasonably expected of a competent practitioner operating within this field.

 

However:

​

  1. Information provided is based on the information available to us at the time and may be influenced by the completeness and accuracy of the information provided by the client.

  2. Individual responses to nutrition, lifestyle, supplementation and other recommendations vary between clients.

  3. No particular health outcome, symptom improvement or result can be guaranteed.

  4. Testimonials and examples of client outcomes represent the experiences of those individuals and are not a guarantee that another client will achieve the same result.

  5. Recommendations may be amended where new information becomes available, circumstances change, products become unavailable, or professional judgement indicates that an adjustment is appropriate.

  6. Nothing in these Terms and Conditions excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded under applicable Australian law.

4. Website & Website Visitor Responsibilities

When using this website or accessing our general educational content, you agree that:

  1. You will use your own judgement when considering general health and nutrition information.

  2. You will seek appropriate professional medical advice before making significant changes to your health, diet, medication, supplementation or exercise where appropriate.

  3. You will provide accurate and complete information if you choose to engage Jules McKie Health for personalised services.

  4. You understand that general website content is not personalised medical advice.

  5. You acknowledge that accessing website content alone does not create a practitioner-client relationship.

5. Downloads & Digital Content

Digital downloads, e-books and other downloadable materials are provided for educational purposes. While reasonable care is taken in providing these materials, Jules McKie Health does not warrant that downloads will be uninterrupted or completely free from technical issues, viruses or other harmful components. You are responsible for maintaining appropriate security and protection on your own device.

6. Intellectual Property & Copyright

All content appearing on the Jules McKie Health website and within Jules McKie Health programs, protocols, resources, documents, e-books and other materials is protected by copyright and remains the intellectual property of Jules McKie Health unless otherwise stated.

You must not reproduce, copy, distribute, modify, publish, sell, licence, commercially exploit or otherwise reproduce our materials without prior written permission.

​

You may share Jules McKie Health social media content for personal, non-commercial purposes provided that appropriate credit is given and, where applicable, a link to the original source is retained.

7. Business Name & Brand

The name Jules McKie Health, associated branding, logos and other proprietary business materials may not be used, reproduced or represented as belonging to another person or business without prior written permission.

8. Suitability

Our services are intended for individuals who are willing and able to participate actively in their health and wellbeing journey and who understand that meaningful change requires personal participation and implementation.

Recommendations are designed to be individualised and implemented at a pace appropriate to the client's circumstances.

​

Jules McKie Health does not guarantee that a client will be suitable for every service or program. Where significant circumstances arise that may make our services unsuitable, or where additional emotional, psychological, medical or other professional support is indicated, we may recommend that the client seek support from an appropriately qualified practitioner.

​

9. Client Responsibilities

You agree to provide complete, accurate and current information relevant to your health and circumstances. This includes, where applicable:

​

  • current and previous health concerns;

  • diagnosed medical conditions;

  • medications;

  • supplements;

  • allergies and intolerances;

  • relevant pathology or test results;

  • relevant lifestyle information; and

  • any other information reasonably requested for the purpose of providing the service.

​

You understand that incomplete, inaccurate or withheld information may affect the appropriateness of recommendations and the ability to provide services safely and effectively. You are responsible for notifying Jules McKie Health of any significant changes to your health, medications, supplements, circumstances or symptoms during your program. You are also responsible for communicating any concerns, adverse reactions or unexpected symptoms promptly.

BUSINESS POLICIES

10. Privacy & Confidentiality

Jules McKie Health respects the privacy and confidentiality of client information and handles personal information in accordance with applicable privacy laws and our Privacy Policy. Personal information will only be collected, used, stored and disclosed for appropriate purposes associated with providing services, administering the business, complying with legal obligations, or as otherwise permitted or required by law.

11. Payment Terms

All prices are quoted in Australian dollars unless otherwise stated. Payment for online consultations is required at the time of booking or no later than 48 hours prior to the scheduled consultation. Any additional services, appointments, testing, interpretation, administration or other chargeable services must be paid for as advised at the time of purchase or prior to the service being provided.

​

Where payment is processed through a third-party payment provider, that provider may collect and process payment information in accordance with its own privacy policy and terms. Jules McKie Health does not retain full bank account or credit card details.

​

12. Optimised Health Packages

Optimised Health Packages are designed to provide personalised functional nutrition and health optimisation support based on the client's individual circumstances, health information, symptoms, functional interpretation of available pathology and/or other recommended testing.

​

Depending on the package purchased, services may include:

​

  • a comprehensive health discovery consultation;

  • functional blood chemistry interpretation;

  • symptom analysis;

  • personalised nutrition and lifestyle recommendations;

  • a tailored multi-phased protocol;

  • protocol implementation;

  • protocol progress appointments; and

  • embodied health check-in appointments.

 

The number of appointments included in each package will be outlined in the relevant package information provided at the time of purchase. Additional appointments may be purchased separately where available.

​

Package validity

Unless otherwise agreed in writing, Optimised Health Packages have a 6-month validity period. The six-month period commences from the client's engagement and protocol implementation. The client is responsible for commencing and progressing through their personalised protocol within this period.

 

Where a client requires continued support after the applicable six-month period, a $395 re-engagement fee will apply before services are recommenced.

​

13. Delays, Extensions & Re-engagement

Clients are expected to communicate promptly and participate reasonably in the implementation of their program.

Where a client experiences illness, travel, personal circumstances or another legitimate reason that affects their ability to progress, an extension may be considered at the discretion of Jules McKie Health.

​

However, extensions are not automatic and must be agreed in writing. Where delays are caused by the client's failure to commence their protocol within a reasonable timeframe, failure to communicate, repeated requests for extensions, ordering incorrect products, changes in circumstances requiring substantial additional work, or other circumstances reasonably attributable to the client, additional fees may apply.

 

Additional work will be charged at $195 per hour, and a $395 re-engagement fee may apply where the program has moved beyond its applicable validity period. Where an extension is required because of changes made to the protocol by Jules McKie Health, unavoidable supplement availability issues, or circumstances outside the reasonable control of the client and Jules McKie Health, an extension may be granted without additional fees.

​

14. Consultation Package Validity

Where consultation packages are purchased:

​

  • 3-session packages must be used within 3 months of the first attended initial appointment.

  • 6-session packages must be used within 6 months of the first attended initial appointment.

​

Unused appointments after the applicable validity period may expire unless an extension has been agreed in writing.

​

REFUNDS, RETURNS & CANCELLATIONS

15. Change of Mind

Jules McKie Health does not offer refunds solely because a client has changed their mind, no longer wishes to proceed, no longer requires a service or product, or has decided not to use a service or product.

​

This policy applies to consultations, consultation packages, Optimised Health Packages, pathology testing, supplements, digital products and other purchases, subject always to any rights or remedies available under the Australian Consumer Law or other applicable legislation.

​

Nothing in these Terms and Conditions is intended to exclude or limit a consumer's rights where those rights cannot lawfully be excluded.

​

16. SUPPLEMENTS – PURCHASES, RETURNS & REFUNDS

Supplements are consumable products and are purchased separately from professional consultation and health optimisation services unless expressly stated otherwise.

 

Change-of-mind refunds or returns are not available for supplements. This includes circumstances where a client:

​

  • changes their mind;

  • decides they no longer wish to take the supplement;

  • decides the supplement is no longer required;

  • changes their health goals or treatment preferences;

  • purchases a different product elsewhere;

  • does not commence their protocol;

  • has unused supplements remaining; or

  • no longer wishes to continue with their program.

​

Once a supplement has been supplied to a client, Jules McKie Health cannot verify how the product has been stored, handled or maintained. For health, safety and quality-control reasons, supplements cannot ordinarily be returned to stock or resold.

 

Clients are encouraged to ask questions about ingredients, intended use, dosage and suitability before purchasing supplements. Supplement recommendations are based on the information available at the time of consultation and do not constitute a guarantee that a particular product will be suitable under all future circumstances.

​

Faulty, damaged or incorrectly supplied supplements

Nothing in this policy excludes, restricts or modifies any consumer guarantee or other legal right that cannot lawfully be excluded.

​

If a product is faulty, damaged before receipt, incorrectly supplied, or otherwise fails to meet an applicable consumer guarantee, please contact Jules McKie Health as soon as reasonably possible so the issue can be assessed and an appropriate remedy provided where required. 

​

17. Cancellations & Appointment Changes

At least 48 hours' notice is required to cancel an appointment. Cancellations made less than 48 hours before the scheduled consultation may incur a cancellation fee equal to the normal consultation fee.

​

At least 24 hours' notice is required to reschedule an appointment. Requests to reschedule within 24 hours of an appointment will be considered at our discretion and may incur a $25 administration and rescheduling fee.

 

Failure to attend an appointment without notice will result in forfeiture of 100% of the appointment fee. Where Jules McKie Health is unable to proceed with a scheduled appointment due to circumstances on our side, we will offer either a reasonable alternative appointment or, where appropriate, a refund of the affected service.

 

Nothing in this policy limits any rights the client may have under applicable consumer law.

​

18. Intake Forms & Health Information

For package and program clients, an intake form and detailed health history and symptom analysis will be completed before or as part of the initial consultation.​ Clients are requested to return all completed and signed forms and relevant health documentation by email no later than 72 hours after receiving the documentation.

​

Where information is not provided before the appointment, the client may be required to complete the forms during the consultation.​ Consultation time will not ordinarily be extended to compensate for time spent completing outstanding paperwork.

 

If insufficient information is available to properly assess the client's circumstances, additional consultation time or a further appointment may be required and may incur an additional fee.

​

19. Allergies & Adverse Reactions

Clients must disclose all known allergies, intolerances and previous adverse reactions before commencing a consultation or purchasing recommended products.

​

Clients must also notify Jules McKie Health as soon as reasonably possible if they experience an unexpected reaction to a recommended product or protocol component.

​

If a client experiences severe or potentially life-threatening symptoms, including symptoms of anaphylaxis, they should seek emergency medical assistance immediately by calling 000.

​

20. Protocol Implementation

Protocol implementation appointments are generally conducted online via Zoom and may involve screen sharing to review pathology, interpretation, analysis and the client's personalised protocol. Where a client does not have access to a suitable device or reliable internet connection, reasonable alternative arrangements may be discussed.

​

In-person protocol implementation appointments may be available by request and are subject to availability.

Any additional travel, clinic room hire, equipment or other costs associated with a requested in-person appointment will be payable by the client and will be communicated before the appointment where reasonably practicable.

​

21. Expected Results

Jules McKie Health does not guarantee any particular health, nutritional, symptom or clinical outcome. Individual outcomes depend on many factors, including the client's health circumstances, adherence to the protocol and recommendations, lifestyle, environment, medical history and individual response.

​

The client is responsible for implementing recommendations and communicating any concerns, changes or adverse reactions throughout their program. Any examples, testimonials or previous client outcomes presented by Jules McKie Health are illustrative only and do not constitute a promise or guarantee of future results.

​

22. Additional Testing & Interpretation

The cost of additional pathology, functional testing or other testing is not included in Optimised Health Package fees unless expressly stated in the relevant package description. Additional testing requested by the client, or additional testing considered necessary outside the original package scope, will be charged separately.

 

Where Jules McKie Health is requested to organise additional testing or provide additional functional interpretation or analysis, a professional and administrative fee of $395 may apply. Any additional fees will be communicated to the client before the additional service is provided where reasonably practicable.

​

23. Supplements, Nutrition, Lifestyle & Movement Recommendations

The cost of supplements, food, nutrition products, testing, lifestyle products and other items recommended as part of a health optimisation program is not included in the package fee unless expressly stated otherwise. These items are purchased separately by the client.

​

The client is responsible for the cost of any recommended products or services purchased from third-party suppliers.

​

24. Supplement Recommendations, Availability & Substitutions

Supplement recommendations are made based on the client's circumstances, information available at the time, practitioner knowledge, formulation, ingredients, intended purpose, quality considerations and product availability.

Jules McKie Health cannot guarantee that a particular supplement, brand, formulation or product will remain available throughout the duration of a client's protocol.

​

Manufacturers and suppliers may change:

​

  • product availability;

  • formulations;

  • ingredients;

  • dosage forms;

  • packaging;

  • pricing; and

  • supply arrangements.

​

Where a recommended product becomes unavailable, is discontinued, undergoes a significant formulation change, cannot reasonably be obtained, or is no longer considered appropriate, Jules McKie Health may recommend an alternative product.

​

Any replacement recommendation will be selected using reasonable professional judgement and may differ in brand, appearance, price, formulation, dosage form or supplier.

​

Clients should not materially add, remove or substitute supplements within a personalised protocol without first discussing the change where professional guidance is appropriate.

​

Where a client is taking prescription medication, has a diagnosed medical condition, is pregnant or breastfeeding, or is under the care of another healthcare professional, they should discuss relevant supplement changes with their treating practitioner where appropriate.

​

25. Protocol Updates & Amendments

Protocol amendments required as a result of recommendations or changes made by Jules McKie Health will not ordinarily attract an additional amendment fee. However, client-requested amendments or updates outside the original scope of the service may incur a $195 fee per update or amendment.

​

This may include amendments required because of:

​

  • delays in commencing the protocol;

  • changes in the client's location;

  • changes in the client's circumstances;

  • failure to obtain recommended products within a reasonable timeframe;

  • changes requested by the client after the protocol has been prepared; or

  • other circumstances requiring additional professional assessment or administrative work outside the original service scope.

​

Where a change is required because of supplement availability, a change initiated by Jules McKie Health, or another circumstance outside the reasonable control of the client, the amendment fee may be waived at our discretion.

​

26. Specific Terms of Sale

Personalised recommendations and protocols are prepared for the individual client for whom they were created.

Clients must not provide, prescribe, recommend or distribute personalised protocols or supplement recommendations to family members, friends or other individuals.

​

Another person's health circumstances may differ significantly and they should obtain appropriate professional advice before commencing supplements, nutritional protocols or other recommendations.

​

27. Liability

To the maximum extent permitted by law, Jules McKie Health will not be responsible for loss or damage arising from a client's misuse, misinterpretation or unauthorised application of information, recommendations or materials.

​

However, nothing in these Terms and Conditions excludes, restricts or modifies any liability, consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified under Australian law.

​

Jules McKie Health does not accept responsibility for outcomes arising from inaccurate, incomplete or withheld information provided by a client, or from a client's failure to follow professional recommendations, seek appropriate medical care, disclose relevant health information, or communicate significant changes or adverse reactions.

​

Where a client chooses to depart materially from an agreed protocol or recommendation, Jules McKie Health cannot be responsible for the consequences of that decision to the extent permitted by law.

​

28. Changes to These Terms

Jules McKie Health may update these Terms and Conditions from time to time to reflect changes to services, business practices, legislation or other relevant circumstances.

​

The version of the Terms and Conditions applicable to a particular purchase or engagement will be the version in effect at the time of that purchase or engagement, unless otherwise required by law or agreed in writing.

​

29. Acceptance of Terms

By booking a consultation, purchasing a service or product, enrolling in a package or program, or otherwise engaging Jules McKie Health, you acknowledge that you have had the opportunity to read these Terms and Conditions and agree to be bound by them.
